Terms of service

To be an authorized agent of BHM Financial Group, you agree to abide by the terms and conditions contained in this agreement.

Affiliate Agreement and Terms and Conditions of The Agent Program

This agreement describes the entire terms and conditions for participation in the Agent Program. The program is owned and operated by BHM Financial Group. In this agreement, BHM Financial Group will be referred to as BHM.

In this agreement, the term "Agent" refers to you (the applicant). Wherever the agreement refers to "you" or "your", it means "the Agent"; "we" or "our" refers to BHM, "The Customer" refers to an individual refered by the agent for financing.

Commissions

BHM will pay the agent 10% of the total amount up to $250 for all loans that are referred by the agent that are funded and that meet the conditions set out in sections 1 and 2 below:

1. Standard Loan - 2 Years
   If the customer should execute an agreement for a loan with BHM, with terms equal to or exceeding 2 years in length the agent will be awarded 10%. 5% will be awarded immediately and the remaining 5% will be awarded at the beginning of the 2nd year with the condition the agent remains involved in the program and refers a minimum of 1 customer per month in that 12 month period.
2. 1 Year Loan
   If the customer’s loan agreement has terms of 1 year in length, the agent immediately earns 5% commission.

Payment

BHM will send payment to the Agent (either via wire or check) for the applicable commissions at the time of funding of the loan. Only upon approval of financing and funding of the loan will you receive commissions for customers referred. You will not recieve commissions for any customer referred who is not financed.

Order Fulfillment

BHM will be solely responsible for processing every application placed by a customer on The Agent Site.

Customers

Customers who apply for financing and services through The Agent Program will be deemed to be customers of BHM. Accordingly, all rules, policies, and operating procedures concerning customer financing and service will apply to those customers. We may change our policies and operating procedures at any time. Policies will always determine the interest paid by the customer.

Responsibilties of the Agent

The Agent will be responsible for collecting and forwarding (via email or fax) the following documents to BHM:

• Two pieces of photo identification (license and health card)
• Proof of income (2 last pay stubs, letter from employer)
• Photos of exterior and interior of the vehicle
• Clear photo of the vehicle's odometer
• Proof of vehicle insurance
• Proof of ownership of vehicle (car registration, or car title)
• Void cheque
• 3 references

The Agent will also be required to complete and forward (via email or fax) a general vehicle inspection form which entails that the Agent complete a brief, superficial vehicle inspection. The Agent will also take photos of the interior and exterior of the vehicle during this inspection and forward these photos to BHM Financial. Any visible damages to the vehicle must be reported to BHM Financial.

Unsolicited Commercial Email or SPAM

BHM in no way participates in mass unsolicited emailing (i.e. spamming), and all Affiliates are expected to adhere to this policy as well. Violation of this policy will result in the termination of this contract and immediate dismissal from The Agent Program.

Relationship of Parties

You and we are independent contractors, and nothing in this Agreement will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between the parties. You will have no authority to make or accept any offers or representations on our behalf. You will not make any statement, whether on your website or otherwise, that reasonably would contradict this statement.

Term/Termination

This agreement will remain in effect for 1 year. Following the first year, the agreement will be automatically renewed on the on the first of each month until the agreement is terminated by either party.The agreement may be terminated by either party upon 30 days written notice to the other party. Upon termination of this agreement, the Agent will not receive any commissions for any loans not already approved at or after the time of the termination of this agreement.

Limitation of Liability

We will not be liable for indirect, special, or consequential damages (or any loss of revenue, profits, or data) arising in connection with this Agreement or the Program, even if we have been advised of the possibility of such damages. Further, our aggregate liability arising with respect to this Agreement and the Program will not exceed the total commissions paid or payable to you under to this Agreement.

Disclaimers

We make no express or implied warranties or representations with respect to The Agent Program or your potential to earn income from The Agent Program. In addition, we make no representation that the operation of our website will be uninterrupted or error-free, and we will not be liable for the consequences of any interruptions or errors.

Any disputes between the parties to this agreement which involves interpretations of the terms of this agreement shall be submitted to arbitration under the laws of Canada, and the finding of the Arbitrator shall be binding on all parties. You may not assign this Agreement, by operation of law or otherwise, without our prior written consent. Subject to that restriction, this Agreement will be binding on, inure to the benefit of, and enforceable against the parties and their respective successors and assigns. Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement.

By submitting The Agent registration form, you acknowledge that you have read this agreement and agree to all its terms and conditions. You have independently evaluated this program and are not relying on any representation, guarantee or statement other than as set forth in this agreement.
